IN NO EVENT SHALL PIZZA LUCE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES EXCEED THE GREATER OF: (A) ONE HUNDRED UNITED STATES DOLLARS ($100.00), OR (B) THE TOTAL AMOUNT PAID BY YOU TO PIZZA LUCE IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you in full. In such cases, our liability shall be limited to the maximum extent permitted by applicable law.
8. Indemnification
You agree to defend, indemnify, and hold harmless Pizza Luce, its affiliates, subsidiaries, officers, directors, employees, contractors, agents, licensors, and service providers (collectively, "Indemnified Parties") from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to:

For users in other states, applicable state consumer protection laws shall apply to the extent required.
10. Dispute Resolution
10.1 Informal Resolution

The parties agree to use good faith efforts to resolve the dispute informally within thirty (30) calendar days of the date the notice is received. If the dispute is not resolved within this period, either party may pursue formal dispute resolution as described below.
10.2 Binding Arbitration
EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT, ALL DISPUTES, CLAIMS, OR CONTROVERSIES ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL BE RESOLVED THROUGH FINAL AND BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) IN ACCORDANCE WITH ITS CONSUMER ARBITRATION RULES, RATHER THAN IN COURT.
The arbitration shall be conducted in English. The arbitrator shall have the authority to award any remedy that would otherwise be available in court. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Each party shall bear its own attorneys' fees and costs in connection with any arbitration proceeding. The filing fees and arbitrator's compensation shall be allocated in accordance with the AAA Consumer Arbitration Rules.
10.3 Class Action Waiver
YOU AND PIZZA LUCE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR MULTI-PLAINTIFF ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CLASS OR REPRESENTATIVE PROCEEDING.
10.4 Small Claims Court
Notwithstanding the foregoing, either party may bring an individual action in a small claims court of competent jurisdiction for disputes within the applicable monetary limits of such court, provided that the claim is not filed as part of a class action or multi-party proceeding.
10.5 Opt-Out Right
You have the right to opt out of the arbitration and class action waiver provisions set forth in this Section by sending a written notice of your decision to opt out to [email protected] within thirty (30) days of first accepting these Terms. Your opt-out notice must include your name, address, and a clear statement that you wish to opt out of the arbitration agreement. If you opt out, all disputes shall be resolved in accordance with Section 9 (Governing Law and Jurisdiction).
11. Term and Termination
11.1 Term
